US Attorney: ‘Scalia might have impacted Blagojevich case’

SPRINGFIELD – Former Illinois Governor Rod Blagojevich is awaiting re-sentencing in June after prosecutors opted not to retry him on five corruption convictions that were tossed out, and one US Attorney thinks a late Justice could have impacted the case.

Attorney Jon Gray Noll said he believes Scalia had great interest in the issues raised in the Blagojevich case. Noll said he’s unsure if Scalia had a say because many believe the decision was made just a week before the announcement.

“In that case, he would have been deceased by then,” Noll said. “It’d be the kind of guess that I think he would weigh in on.”

Noll said the issue goes far beyond Republicans and Democrats, making it even more appealing to Scalia.

“That’d be the kind of thing he’d like to look at,” said Noll. “It wouldn’t be about being a conservative, it’s just a big case in American politics.”

Blagojevich is four years into a fourteen year prison term.
