WASHINGTON – A case of teachers in California challenging having to pay so-called “fair share” as a condition of employment will be heard by the U.S. Supreme Court later this year and the outcome of the case could have impacts on Illinois and beyond.
The high court announced it will hear the case of teachers objecting to being forced to pay fees unions say help pay for collective bargaining.
A similar case in Illinois brought forth by Illinois Gov. Governor Bruce Rauner also challenged the fee being taken out of employees’ checks saying the forced payment was a First Amendment violation. Several state employees joined Rauner’s case. The courts dismissed Rauner’s case saying he had no standing but they said the employees’ can move forward because they can show not only standing but damages.
Justices will hear the California case this fall.
